1. Services and Processing

Primitive Photo Labs provides professional film development, scanning, and printing services. By submitting film to us, you acknowledge that:

• The Process: Chemical development is a manual and chemical process. While we maintain strict quality control, the nature of film means results can vary based on the age of the film, storage conditions, and camera functionality.

• Blank Rolls: As outlined in our Refund Policy, rolls that result in no images still incur a development fee to cover labor and chemistry. Scanning fees for blank rolls will be refunded.

2. Limitation of Liability (The "Lost or Damaged" Clause)

We treat your film as if it were our own. However, in the event of loss or damage to your film due to lab error, fire, theft, or mechanical failure:

• Our liability is limited to the replacement cost of a non-exposed roll of similar film and a refund of the processing fees paid for that specific roll.

• Primitive Photo Labs is not liable for "sentimental value" or any consequential damages resulting from the loss of images. Submitting film to us constitutes your agreement to this limitation.

3. Digital Delivery & Storage

• Delivery: Scans are delivered via digital download link through WeTransfer. It is the customer's responsibility to download and back up these files.

• Retention: Due to storage limitations, digital files will be hosted for a period of 30 days. After this window, files may be permanently deleted from our servers.

• Old Files: As of February 28, 2026, all legacy files previously hosted on Google Drive have been removed. All new orders are processed via our current delivery system.

4. Physical Assets & Abandoned Orders

• Negative Pickup: Customers are responsible for picking up their physical negatives or selecting a shipping option.

• Disposal: Negatives not claimed within 30 days of the "Ready for Pickup" notification will be considered abandoned and may be destroyed or recycled to protect customer privacy and manage space.

5. Shipping

Primitive Photo Labs is not responsible for film lost or damaged by third-party mail carriers (USPS, UPS, FedEx) during transit to or from our lab. We strongly recommend using tracked shipping for all submissions.

6. Prohibited Content

We reserve the right to refuse service for any film containing illegal content. While we respect artistic expression, we will comply with all local and federal laws regarding the processing of certain imagery.

7. Intellectual Property

All content on this website—including logos, text, and images—is the property of Primitive Photo Labs and may not be used without express written permission. You retain full copyright of the images we process for you.

7.1 Customer Ownership & Copyright: While Primitive Photo Labs retains all rights to the design, text, and original assets of this website, we claim no ownership over the images contained on your film or digital scans. You retain full and exclusive copyright to your photographs. Our role is strictly limited to providing a service to develop and digitize your work; we will never use your images for marketing or social media purposes without your explicit, written consent.
